Muslim travelers say they're still saddled with 9/11 baggage

'There is no uniformity in the way in which the Department of Justice applies the law at every level'

Government records show that Hassan Shibly of Tampa, Fla., has been pulled aside at airports for secondary screening at least 20 times since 2004.

Imagine it is 5 a.m. and you’ve landed in New York after a 12-hour overseas flight. Standing in the line for U.S. citizens, you wait as a border agent asks passengers ahead a few cursory questions, then waves them through. Your family is instead ushered into a separate room for more than an hour of searching and questioning.

This was the welcome that Hassan Shibly, traveling with his wife and infant son, said they received in August 2010, when they returned to the United States from Jordan, after traveling to Mecca.

“Are you part of any Islamic tribe? Have you ever studied Islam full time? How many gods do you believe in?” “How many prophets do you believe in?” the agent at New York’s JFK Airport asked, according to Shibly, 24, a Syrian-born Muslim American. He said the agent searched his luggage, pulling out his Quran and a hand-held digital prayer counter.

“At the end — I guess (the agent) was trying to be nice — he said, ‘Sorry, I hope you understand we just have to make sure nothing gets blown up,’” said Shibly, a law school graduate who grew up in Buffalo.

A decade after Islamic extremists used airplanes to attack the World Trade Center and the Pentagon, Muslim American travelers say they are still paying the price for terror attacks carried out in the name of their religion. At airports, ports and land crossings, many contend, they are repeatedly singled out for special screening and intrusive questioning about their religious beliefs. Others say they have been marooned overseas, barred from flights to the United States.

‘Stories come pouring out' “Whenever a group of Muslims sit together … stories come pouring out,” said real estate agent Jeff Siddique, a Pakistan-born U.S. citizen who has lived in Seattle for 35 years. “It’s story after story after story.”

That is supported by a survey released in August by the Pew Research Center, in which 36 percent of Muslim Americans who traveled by air in the last year said they had been singled out for special screening. The Transportation Security Administration does not keep detailed records, but a spokesman said that less than 3 percent of passengers receive a pat down, a primary form of secondary screening.

Rooting out 'extremist tendencies' The difficulty is knowing where policy ends and personal discretion kicks in.

For example, depending on how the directive to focus on travelers to and from countries with active terrorist organizations is interpreted, it might implicate a large swath of American Muslims. The majority of this population is made up of recent immigrants with connections to their countries of origin in the Middle East, North Africa and South Asia.

But Homeland Security recently launched an investigation of a flurry of complaints from Muslims who, like Shibly, say border agents went well beyond asking about their travels. Instead, the travelers say, they were questioned extensively about their religious beliefs and practices. Some reported being asked political questions, such as their views on the Iraq War or President Barack Obama.

One complaint filed by the nonprofit Council on American Islamic Relations with Homeland Security and the Justice Department said its Michigan branch alone has received “dozens of reports (from Muslim travelers) … that CBP agents pointed firearms at them, detained and handcuffed them without predication of crimes or charges, and questioned them about their worship habits.”

Shibly’s case is one of five included in a separate complaint filed by the the nonprofit Muslim Advocates and the American Civil Liberties Union in December.

Another case detailed in the complaint is that of New Jersey resident Lawrence Ho, who says that when he reached the U.S. border from Canada by car in February 2010 he was surprised to find the border agent knew that he had converted to Islam. Ho, who is Chinese American, said the border agent questioned him for nearly four hours about his Muslim beliefs. But an email to the CBP to complain about the encounter at the Rainbow Bridge checkpoint in New York didn’t get far.

"In 2001, the U.S. was attacked by Islamist extremists,” wrote a senior CBP officer in an email response to Ho. “If a CBP officer inquires as to a person's religious beliefs in order to uncover signs of extremist tendencies, that officer is well within his authority."

It is not clear if that statement is in line with Homeland Security policy. In response to msnbc.com queries, Homeland Security did not offer any detail about the ongoing investigation, but provided a general statement by email.

DHS does not tolerate religious discrimination or abusive questioning – period,” wrote Homeland Security spokesman Chris Ortman. The department's office of Civil Rights and Civil Liberties “has notified the complainants and their representatives that it will investigate these allegations and, if appropriate, the department will take corrective action.”

The ACLU and Muslim Advocates also filed a Freedom of Information Act request, seeking all records, standards and statistics pertaining to CBP questioning on religious and political beliefs and practices, border training programs and disclosure of how the travelers’ information is used.

“We hope … (DHS) will condemn the practice of asking any citizen or legal resident of the U.S. about their religious beliefs, political beliefs and religious practices,” said ACLU staff attorney Nusrat Choudhury. “We also hope that (it) will note the troubling nature of the fact that so many Muslim legal residents or citizens are being asked these kinds of questions.”

اپنے اس خواب کو شرمندہ تعبیر کرنے کے لئیے اس نے پہاڑی پتھروں سے تقریباَ پچپن فٹ اونچی اور کئی گز چوڑی دیوار تعمیر کی اور اس کے درمیان اتنا ہی بلند آہنی فلڈ گیٹ نصب کروایا، جس پر اس وقت آج کے حساب سے تقریباَ تیس ملین ڈالر خرچ ہوئے، سالوں کی محنت رنگ لائی اور انیس سو ستر میں یہ گیٹ اور دیوار مکمل طور پر تعمیر ہوگئے۔
اس وقت کچھہ لوگوں نے کوٹاکو وامورا کے اس اقدام کو احماقانا اور پیسے کا زیاں قرار دیا مگر کوٹاکو جانتا تھا کے اس پر اعتراض کرنے والے وہ لوگ ہیں جنہیں اپنی ناک سے آگے کچھہ نظر نہیں آتا وہ کیا عشروں کے پار دیکھیں گے۔

آج تقریباَ چالیس سال بیت گئے اس گیٹ کو لگے پچھلے دنوں جو سونامی آیا اس میں بہت بڑی تباہی مچی ہزاروں کی تعداد میں لوگ ہلاک ہوئے مگر کوٹاکو کے چالیس سال پہلے کئے ہوئے اقدام کی وجہ سے فدائی کے لوگ سونامی سے بلکل محفوظ رہے، کوٹاکو اب اس دنیا میں نہیں رہا مگر آج جاپان میں ہر شخص معترف ہے کوٹاکو کے ویژن کا اور شکر گزار ہیں اپنے محسن کا کہ اسکے ویژن کی وجہ سے اسکی عشروں کے پار دیکھنے کی صلاحیت کی وجہ سے فدائی اتنی بڑی تباہی سے بچ گیا۔

اسے کہتے ہیں ویژن، اسے کہتے ہیں عشروں کے پار دیکھنے کی صلاحیت، اسے کہتے ہیں قوم کا سچہ محسن، اسے کہتے ہیں محب وطن،انہیں کہتے ہیں اشرف المخلوقات۔ جبکہ ہمارے جیسے معاشروں میں جہاں اپنے آج کے بارے میں کوئی سوچنے کو تیار نہیں وہاں آنے والے کل کے بارے میں کوئی کیا سوچے گا، جہاں بچپن سے ہی ذہنوں میں یہ غلاضت انڈیلی جاتی ہو ( سامان ہے سو برس کا پل کی خبر نہیں ) تو ایسے معاشرے کے بچے بڑے ہونے کے بعد کیا فکر کریں کے اپنی یا اپنی آنے والی نسلوں کے کل کے لئیے۔

جیسا دودھہ ہوتا ہے ویسا ہی مکھن ہوتا ہے، جیسے جاہل حکمران ویسے ہی جاہل عوام، جیسے زنگ آلود ذہنیت کے حامل مولوی حضرات ویسی ہی بند ذہنیت کے پیروکار۔ نیم کے درخت میں آم کبھی بھی نہیں اگ سکتے۔ بھیک اور امداد جس معاشرے میں باقائدہ صنت کی صورت اختیار کر گئی ہو وہ معاشرے اپنے قدموں پہ کبھی بھی کھڑے نہیں رہ سکتے، سیاسی جماعتیں اپنے امور چلانے کے لئیے فنڈز کی بھیک مانگتی ہیں، مذہبی جماعتیں جہاد کے نام پہ امداد بٹور رہے ہوتے ہیں، مولوی حضرات مسجد اور مدرسے کے نام پر بھیک مانگ رہے ہوتے ہیں، نہ صرف خود مانگ رہے ہوتے ہیں بلکے معصوم بچوں کے ہاتھہ میں کٹورا دے کر سڑکوں پہ چھوڑ دیا جاتا ہے، یعنی ابتداء ہی بھکاری پن سے ہوتی ہے، اور نعرے تو سنو انکے۔ سبق پھر پڑھہ صداقت کا شرافت کا دیانت کا۔ لیا جائے گا تجھہ سے کام دنیا کی امامت کا۔

حکمراں ملک چلانے کے لئیے دنیا سے بھیک مانگ رہے ہیں، اوپر سے نیچے تک پوری قوم بھکاری بن چکی ہے، بھکاری کا سب سے بڑا المیہ یہ ہوتا ہے کے اسکی دعا اسکے اپنے حق میں قبول نہیں ہوتی، اگر ہو رہی ہوتی تو بھکاری، بھکاری ہی نہ رہتا۔
صدر صاحب قوم کو بیوقوف بنانے کے لئیے دنیا سے کہتے ہیں کے ہمیں ایڈ نہیں ٹریڈ چاہئیے، ہم بناتے کیا ہیں جو ٹریڈ کریں گے؟ کوئی ایک ایسی چیز جو پوری دنیا میں صرف ہم بنا رہے ہوں اور پوری دنیا لائن لگا کر ہماری اس پروڈکٹ کی خریدار ہو؟ یہ تو اللہ کی مہربانی ہے کے زمین زرخیز ہے تو یہاں کچھہ اناج وغیرہ اگ جاتا ہے جو کے اپنی عوام کے لئیے کم پڑتا ہے، کسی بھی ملک کی معیشت اسکی ایکپورٹ سے مظبوط ہوتی، ہماری ایکسپورٹ بیس ارب ڈالر کی ہے یعنی بیس ارب ڈالر ہم دنیا سے پاکستان میں لے کر آتے ہیں، جبکہ ہماری امپورٹ تقریباَ بیالیس ارب ڈالر کی ہے، یعنی بیس ارب ڈالر آئے اور بیالیس ارب ڈالر واپس چلے گئے، اسے کہتے ہیں ٹریڈ ڈیفیسٹ۔

ہم ایک کلو چاول انہیں ایکسپورٹ کرتے ہیں وہ ان ہی چاولوں کی چار کلو بریانی بنا کر واپس ہمیں ایکسپورٹ کردیتے ہیں، ہم کاٹن کا پورا جہاز بھر کے بھیجتے ہیں اور خوشی سے پھولے نہیں سماتے جبکہ وہ ایف سولہ طیارے کا ایک چھوٹا سا پرزہ ہمیں دے کر ہمارے پورے کاٹن کے جہاز سے کہیں زیادہ کی قیمت ہم سے وصول لیتا ہے۔ امپورٹ کسی بھی ملک کی معیشت پر بوجھہ کی حیثیت رکھتی ہے انتہائی ضروری اشیاء کی امپورٹ کی جانی جائیے جیسے کے لائف سیونگ ڈرگز پیڑول وغیرہ، جبکہ یہاں یہ حال ہے کہ، ائس کریم، چاکلیٹس، فلاورز، یہاں تک کے انڈر گارمنٹ تک امپورٹ کیئے جاتے ہر سال ایک سے ڈیڑھہ  ارب ڈالر کے تو موبائل ہی امپورٹ کر لیتے ہیں ہم، جبکہ اس سے کہیں کم لاگت میں پوری موبائل انڈسڑی لگائی جاسکتی ہے یہاں، مگر یہ سب سوچے گا کون؟۔

اور پھر کس بات کی ٹریڈ کیا بھیجیں کے ہم ؟ بناتے ہی کیا ہیں ہم؟ دہشت گرد، خود کش بمبار، انتہاپسند، جاہل، اجڈ، گنوار، یہ ہیں ہماری مین پروڈکٹس اب انکے خریدار کہاں سے لائیں گے ہم ٹریڈ کرنے کے لئیے؟۔ جس قوم کو پیدا ہوتے ہی مرنے کا سبق پڑھایا جائے تو ایسی ہی سوچ اور ایسا ہی معاشرہ بناسکتی ہے ایسی قوم۔ لکھنے اور مثالیں دینے کے لئیے اور بہت کچھہ ہے مگر اتنا ہی ہضم ہوجائے لوگوں کو تو عافیت جانوں۔

act No. 1: On August 24, 2002 Dr Aamir presented his foreign degrees to the Registrar of Karachi and got his provisional approval on the same day. See Registrar’s letter The letter talks of “foreign degrees” so it is clear that Dr Aamir presented more than one foreign degree to get its equivalence. In fact he presented all the three degrees he had purchased from Trinity College, that of BA, MA and PhD.

Fact No 2: Dr Aamir admits in his Dawn interview: “True, I attached my honorary PhD degrees along with my other medical degree when I filed my nomination papers, but I ask, what’s wrong in that.” He had bought only one PhD degree from Trinity College which was authenticated by the Karachi University Registrar. The other two degrees he attached with his nomination papers, of BA and MA, were also authenticated by the Registrar. See copies BA | MA | PhD

Fact No. 3: He had no MBBS degree from Jamshoro University when he filed his nomination papers because if he had that degree, there was no need to rush to the Registrar with fake degrees, get a letter of authentication on the same day and try to break the Law of the land. This explanation is all an after-thought and it is possible as a Minister he may have managed to get a MBBS degree attached to his nomination papers in the Election Commission. In Pakistan everything is possible in the age of Enlightened Moderation.

Fact No. 4: Dr Aamir claims his PhD degree had nothing to do with his nomination papers. But why did he buy and present the BA and MA degrees to the Election Commission has not been explained by him and that is where he gets caught lying.

Fact No. 5: He says he got his MBBS degree in 1995 from Jamshoro College. But the BA Degree he got from Trinity College is dated 17 March 1995. Is this not a joke? It is an open fraud. Fact No. 6: Trinity College and University’s web address (URL) was registered under the name of: KSR Consulting,1403-1901 19 ST NE, Calgary, Alberta T2E4Y4, Canada. Fact No 7: When the college itself was registered in 2000, and that too in Canada and not in Spain as Dr Aamir claims, although they do have a Spanish address, how can it issue a degree to Dr Aamir dated March 17, 1995. It is thus a fake degree and when Dr Aamir got it authenticated from the Registrar of Karachi University, he committed a criminal act, an outright fraud.

Fact No 8: The degrees Dr Aamir admitted he attached with his nomination papers for the 2002 election do not say anywhere that these are “Honorary” Degrees. In fact the PhD Degree states on its face in bold and capital letters: "The Trinity College has conferred upon Dr Aamir Liaquat the Degree, Rank and Academic Status, Doctor of Philosophy in Islamic Studies.” It further adds: “All requirements of the Board of Regents and Examiners having been completed. All rights and Privileges thereunto appertaining are hereby awarded.” Is this the language of an Honorary Degree. See Face of Degree

Fact No 9: Trinity College offers an All-in-One Package to its customers for UK Pounds 500 (US$960) in which all three degrees, Bachelors, Masters and Doctorate are offered together. Fact No 10: Dr Aamir has not explained or clarified why would a commercial company selling its products to the rest of the world offer an almost 1000-dollar package free of cost to him making him an “Honorary” Doctor in a subject in which the College has no experience. What services did he render to the Trinity College and who is he trying to fool?
